Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of GravyPicks (the "Service"), operated by GravyPicks LLC ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy and Disclaimer. If you do not agree, do not use the Service.

2. What we provide

GravyPicks is a sports betting analysis and entertainment service. We publish daily editorial content — including pick recommendations, parlay constructions, totals analysis, injury notes, and other contextual data — for entertainment and informational purposes only. We do not accept wagers, hold customer funds, or facilitate gambling transactions of any kind.

3. Eligibility

  • You must be at least 21 years old, or the legal gambling age in your jurisdiction (whichever is higher).
  • You must be a legal resident of the United States.
  • You must have the legal capacity to enter into a binding contract.
  • You must not be barred from using gambling-related services under applicable law.

By using the Service, you represent and warrant that all of the above are true.

4. Account registration

Account creation and authentication are handled by Clerk Inc., a third-party identity provider. You agree to provide accurate, current, and complete information when registering. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

5. Subscriptions and billing

Pricing

The "Pro" subscription is currently priced at $20.00 USD per month, billed in advance via Stripe. We reserve the right to change pricing on 30 days' notice; price changes will not affect any billing period you have already paid for.

Auto-renewal

Pro subscriptions automatically renew each month on the same calendar day until you cancel. Your payment method will be charged on each renewal date until you cancel. By subscribing, you authorize us (via Stripe) to charge your payment method for recurring subscription fees.

Cancellation

You may cancel your subscription at any time from your Account page or by contacting us. Cancellation takes effect at the end of your current paid billing period; you will retain access to Pro features until that date. We do not offer pro-rated refunds for partial months.

Refunds

All payments are non-refundable except where required by applicable law or in our sole discretion. If you believe you were billed in error, please contact us within 14 days of the charge and we will review your request in good faith.

Failed payments

If a recurring payment fails, we may suspend access to Pro features until payment is successfully collected. We may retry the charge several times within 7 days, after which the subscription will be canceled automatically.

6. Acceptable use

You agree that you will NOT:

  • Resell, redistribute, republish, or commercially exploit any content from the Service without our written permission;
  • Scrape, crawl, or use automated tools to harvest content from the Service;
  • Share your account credentials with any other person;
  • Use the Service to violate any law, regulation, or third-party right;
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service;
  • Use the Service in any state or jurisdiction where doing so would be unlawful.

7. Content and intellectual property

All content published on the Service — including text, graphics, logos, picks, analysis, parlay constructions, audio content, and the software powering the Service — is owned by us or our licensors and is protected by U.S. and international copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the content for your own personal, non-commercial use.

8. No guarantees

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of any pick, statistic, or other content. Past performance does not predict future results. 9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST WAGERS, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.00.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To that extent, the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless GravyPicks LLC and its officers, directors, employees, and agents from any claim, liability, damage, loss, and expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) your wagering activity of any kind.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. You may terminate your account at any time by canceling your subscription and contacting us to delete your data.

12. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Berrien County, Michigan, and you and we consent to personal jurisdiction in those courts.

13. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or by posting a notice on the Service at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
